New York State Licensing Regulations for Real Estate Salespersons


In order to sell real estate and represent clients, you must be licensed under New York State Law. The law that governs licensing of real estate salespersons is section 440-a of Article 12-A of the Real Property Law in New York State.
There are two types of licenses issued in New York State, a Salesperson’s license and a Broker’s license. 
In order to obtain a salesperson’s real estate license you need to complete and pass a 75 hour course at an accredited school. The salesperson’s qualifying course, as it is called, can be taken live or on-line. Applicants are also required to pass the New York State licensing exam.
Once an applicant has completed the required 75 hour course and passed the NYS licensing exam a license will be issued by New York State. In order to practice the salesperson must be sponsored by a licensed Broker like HUNT ERA. The State holds the sponsoring Broker responsible for the supervision and the activities of the licensed salesperson.
In order to obtain a Broker’s license, a licensed salesperson must complete 120 hours of training. The 75 hours taken by a salesperson in the last 8 years can count toward this 120 hours. The applicant for a Broker’s License must verify that they have a minimum of two years of active participation in real estate and the experience and general knowledge to conduct business. If a Broker is sponsored by a company with a Principle Broker like HUNT ERA, they are called a Broker Associate.
In addition to the initial hours of training, Licensed Salespersons, Associate Brokers and Principle Brokers must complete a minimum of 22.5 hours of continuing education every two years in order to maintain and renew their New York State real estate license.
